These Terms & Conditions (“Terms”) govern your use of levitexlifts.com (“the Website”) and the services offered by Levitex Lifts (“we”, “us”, “our”). 1. Definitions

Client / Customer: Any person or entity who accesses the Website or purchases services from us.
Services: All lift related services including but not limited to installation, maintenance, repair, modernization, consultation, inspections, or any other service offered by Levitex Lifts.
Products: Any elevator / lift equipment, parts, accessories or related hardware supplied by us.
Agreement: Any contract between Levitex Lifts and the Customer for the supply of Products or performance of Services, incorporating these Terms.

2. Use of Website

You agree to use the Website only for lawful purposes.
You agree not to use the Website in any way that may damage, disable, or impair our servers or networks.
We may suspend or terminate access to the Website (or parts thereof) without notice for any reason, including breach of these Terms.

3. Quotation, Orders & Acceptance

All enquiries for Products or Services are subject to our acceptance. A quotation provided by us is valid for [e.g. 30] days unless otherwise stated.
Placing an order implies that you accept these Terms. Once we accept the order (in writing or otherwise), a binding Agreement is formed.

4. Pricing & Payment

5. Delivery, Installation & Performance of Services

You must provide access, site preparation, and any other requirements (permits, approvals etc.) at your expense as necessary to allow us to perform our obligations.

6. Warranty & Defects

We warrant that Products supplied shall be of satisfactory quality and free from material defects, and Services provided with reasonable care and skill.

This warranty does not apply to defects or damage arising from misuse, neglect, unauthorised modification, improper maintenance, or external causes beyond our control.

7. Liability & Limitation

Subject to mandatory statutory rights, in no event shall we be liable for indirect, incidental, special or consequential damages, loss of profits, business or revenue, or loss of use.
Our total liability under any Agreement is limited to the total Contract Price you paid to us under that Agreement.
No liability is accepted for delays, defects or failures caused by items or conditions outside our control (e.g. site conditions, acts of third parties, regulatory impediments).

8. Intellectual Property

All intellectual property rights in materials, designs, drawings, documents and any other material we produce remain the property of Levitex Lifts unless otherwise agreed in writing.
You may only use such materials for the purpose for which they were provided, and you may not reproduce, copy, adapt or distribute them without our prior written consent.

9. Customer Responsibilities

You must ensure all information provided (e.g., site measurements, conditions, site access) is accurate.
You are responsible for obtaining all necessary permits, approvals, regulatory compliance required for installation or service.
You must allow safe access to personnel, site, power supply etc., and comply with safety regulations.

10. Cancellation & Termination

Either party may terminate an Agreement in the event of a material breach by the other, provided a written notice is given and the breach is not remedied within [e.g. 14] days.
If you cancel after work has started, you may be required to pay for work done, materials ordered, or other incurred costs.
Upon termination, you must pay for all Products delivered and Services rendered to the date of termination.

11. Force Majeure

We shall not be liable for any failure or delay in performing our obligations if caused by events beyond our reasonable control, including but not limited to: natural disasters, wars, strikes, pandemics, government actions, supply shortages, or other unforeseen events.

12. Privacy & Data Protection

Your submission of personal data shall be governed by our Privacy Policy [link]. We will comply with applicable data protection laws (e.g., Malaysia’s PDPA).

13. Dispute Resolution & Governing Law

These Terms and any Agreement shall be governed by the laws of Malaysia.
Any dispute arising out of or in connection with these Terms shall be subject to the non-exclusive jurisdiction of the courts of Malaysia.
We may attempt mediation or alternative dispute resolution before litigation.

14. General

No waiver: If we do not enforce any right under these Terms, it does not waive our right later.
Severability: If any provision of these Terms is found invalid, illegal or unenforceable, that provision shall be severed, and the rest of the Terms remain in force.
